TRAILER RENTAL AGREEMENT
Date: Florida Boat Trailer Rentals, LLC, a Florida limited liability company (the "Company"), hereby rents to the Renter identified below, the boat trailer identified below. The rental is made pursuant to the terms and conditions set forth below.

RENTAL TERMS AND CONDITIONS
- Renter shall maintain and keep the trailer in a good state of repair during the rental period.
- If the trailer is put in the water to launch or take a boat out there will be a $100 dip fee.
- The trailer bunks are set by the company. Renter is responsible for putting them back in place. There is an hourly rate of $150 an hour to re-set the bunks.
- Renter is responsible for making sure their vehicle can trailer the intended boat and weight. Customer is also responsible for making sure their ball and hitch GVWR is greater than the boat + plus trailer weight. If not, Florida Boat Trailer Rentals will have one available for Rent. Rental kits are $100 and last the time of the trailer rental.
- There is a $500 deposit on all trailers. Only $400 of which will be returned. The $100 will be used for tolls and other accrued expenses.
- By signing this waiver you give Florida Boat Trailer Rentals the permission to keep and bill the card on file for damages, extra tolls, and any other accrued expenses.
- Delivery and Pick up is $150 an hour.
- If a trailer is not returned to 3535 Recker Highway, Winter Haven, FL 33880 the deposit is forfeited and $150 an hour to pick up and drop off is billed to the Renters card on file.
- All card transactions will incur a 3% card fee on top of the 7% sales tax.
- Under no circumstance is the renter allowed to let anyone else tow or use the trailer.
- There are no refunds. Once a trailer is rented that time slot and date have been reserved and other clients have been turned away.
- Renter has provided to the Company a copy of a credit card maintained by Renter, and Renter authorizes the Company to charge against the credit card all amounts owed to the Company under this agreement if those amounts are not paid by Renter. The deposit will be held in a non-interest bearing account and may be used by the Company as a setoff against any amounts owed to the Company and not otherwise paid by the Renter.
- Renter will pay all tolls.
- Renter has provided to the Company proof of insurance that Renter is insured against any loss, cost, damage, or expense caused to a third party during the use of the Trailer. Renter warrants that the insurance information Renter has provided to the Company is true and accurate and that Renter will maintain the insurance during the term of the rental of the trailer.
- The terms of this agreement are accepted by Renter. Renter agrees to fulfill all obligations imposed on Renter by this agreement.
- The Trailer Inspection and Trailer Rental Policies Agreement attached hereto are incorporated into and are a part of this agreement.
- The rental period shall be for a period of not less than 5 days.
- Renter shall maintain and keep the trailer in a good state of repair during the rental period.
- Renter shall not take or cause the trailer to be taken outside the State of Florida.
- The Renter shall pay the Company the full replacement cost of any trailer which is not returned because it is lost or stolen. Renter shall pay the Company the cost to repair, including parts and labor, any trailer which is damaged before it is returned. The Company's invoice to Renter for either replacement or repair is conclusive as to the amount Renter shall pay under this paragraph for repair or replacement.
- The Renter shall inform the Company, upon request, of the exact location of the trailer at any time while the trailer is in the Renter's possession. Trailers are not to be taken outside the State of Florida.
- The trailer shall be delivered to Renter and returned to the Company at Renter's risk, cost, and expense. Rental charges will be billed to the Renter for each period or portions of the period from the time the trailer is delivered to Renter until its return. Rental charges will be billed to the Renter for no less than 5 days of rental even if the trailer is returned before the end of the fifth day of the rental. If the trailer is not returned during or at the end of the term, the rental charges shall continue until the trailer is returned.
- No allowance will be made for any rented trailer which is claimed not to have been used the full term of the rental.
- Acceptance of a returned trailer by the Company does not constitute a waiver of any of the rights the Company has under this agreement.
- If the Renter is in default of any of the terms and conditions of this agreement, the Company, and its agents, at the Renter's risk, cost, and expense may at any time enter the premises at which the rented trailer is located or used and recover the trailer.
- The Renter shall not pledge or encumber the rented trailer in any way.
- The Company may terminate this agreement immediately upon the failure of Renter to make rental payments when due, or upon Renter's filing for protection from creditors in any court of competent jurisdiction.
- All Transporters $500 deposits will be held for 30 days to pay all tolls.
- There will be a $250 fee for any lost or misplaced tag.
- The Company makes no warranty of any kind regarding the suitability or condition of the rented trailer, except that the Company shall replace the trailer with identical or similar trailer if the trailer fails to operate in accordance with the manufacturer's specifications and operation instructions. Renter has inspected the trailer and is satisfied with its condition. Any replacement of a trailer under this paragraph shall be made as soon as practicable after Renter returns the non-conforming trailer.
- Renter hereby indemnifies and holds the Company harmless from and against all losses, costs, damages, expenses, and claims of any kind, including property and personal injury claims, incurred by or made against the Company, its employees, agents, and owners which arise out of or are related to the use of the trailer until the trailer is returned to the Company.
- The Renter shall pay all reasonable attorney and other fees, expenses, and costs incurred by the Company as a result of Renter's failure to comply with the terms of this Agreement, including any action by the Company to collect from the Renter any amounts owed under this agreement.
- Renter acknowledges receipt of a complete copy of this rental agreement and its attachments.
- All trailers must be returned if any named storm or hurricane is within 100 miles of Florida. This is regardless of rental time or period. If the trailer is not returned, the customer is responsible for paying the hurricane pricing for the trailer. The customer will be refunded their money for the time not used.
